Pakistan Senate chairman election IHC rejects Yousaf Raza Gillani's petition

 

The Islamabad High Court (IHC) on Wednesday rejected former prime minister Yousaf Raza Gillani's petition challenging the Senate chairman election results, ruling that it is inadmissible for hearing. 

The former prime minister — who was the Pakistan Democratic Movement's (PDM) joint candidate challenging the government candidate Sadiq Sanjrani — had lost the Senate chairman election by obtaining 42 votes compared to Sanjrani's 48. 

اسلام آباد ہائیکورٹ نے بدھ کے روز سینیٹ کے چیئرمین انتخابی نتائج کو چیلنج کرنے والی سابق وزیر اعظم یوسف رضا گیلانی کی درخواست کو مسترد کرتے ہوئے یہ فیصلہ سنایا کہ یہ سماعت کے لئے ناقابل قبول ہے۔

سابق وزیر اعظم جو حکومت کے امیدوار صادق سنجرانی کو چیلینج کرنے والے پاکستان ڈیموکریٹک موومنٹ (پی ڈی ایم) کے مشترکہ امیدوار تھے - سنجرانی کے 48 کے مقابلے میں 42 ووٹ حاصل کرکے سینیٹ کے چیئرمین انتخابات سے محروم ہوگئے تھے۔

A 13-page verdict on Gillani's petition was issued by IHC Chief Justice Athar Minallah. 

The PPP had announced it would challenge the verdict after the presiding officer — when the votes were being counted — revealed that seven votes had been rejected. 

According to the judgment, the bench clarified that the court does not interfere in the workings of the Parliament. 

The court also expressed the hope that political parties and lawmakers will resolve their matters with each other without involving the judiciary. 

PPP's Farooq H Naek had filed the appeal on Gillani's behalf at the high court a couple of days earlier. 

In the petition, Gillani had stated that seven votes cast in his favour were rejected by the RO during the election for the Senate chairman. The petition reads that the RO’s order to declare the votes illegal should be overturned.

فیصلے کے مطابق ، بینچ نے واضح کیا کہ عدالت پارلیمنٹ کے کاموں میں مداخلت نہیں کرتی ہے۔

عدالت نے اس امید کا بھی اظہار کیا کہ سیاسی جماعتیں اور قانون ساز عدلیہ کو شامل کیے بغیر اپنے معاملات ایک دوسرے کے ساتھ حل کریں گے۔

پیپلز پارٹی کے فاروق ایچ نائک نے گیلانی کی جانب سے کچھ دن پہلے ہی ہائی کورٹ میں اپیل دائر کی تھی۔

درخواست میں گیلانی نے بتایا تھا کہ سینیٹ کے چیئرمین کے انتخاب کے دوران آر او نے ان کے حق میں ڈالے گئے سات ووٹوں کو مسترد کردیا تھا۔ درخواست میں لکھا گیا ہے کہ آر او کے ووٹوں کو غیر قانونی قرار دینے کے حکم کو کالعدم قرار دیا جانا چاہئے۔

During the Senate election, PDM's Gillani had emerged as the victor from his Islamabad seat, beating Finance Minister Abdul Hafeez Shaikh — associated with the ruling PTI — in what was arguably the most-watched contest.

Gillani had bagged 169 votes, whereas Shaikh got 164. One vote had not been cast.

سینیٹ انتخابات کے دوران ، پی ڈی ایم کی گیلانی اپنی اسلام آباد کی نشست سے فاتح کی حیثیت سے سامنے آئی تھی ، جس نے حکمراں پی ٹی آئی سے وابستہ وزیر خزانہ عبد الحفیظ شیخ کو شکست دی تھی ، جس میں سب سے زیادہ دیکھنے کا مقابلہ تھا۔

گیلانی نے 169 ووٹ حاصل کیے تھے جبکہ شیخ کو 164 ووٹ ملے تھے۔ ایک ووٹ نہیں ڈالا گیا تھا۔
