LAHORE: The Lahore High Court (LHC) suspended on Monday a court order directing the Federal Investigation Agency (FIA) to register a case against Pakistan captain Babar Azam over a harassment complaint.

In the petition, Azam’s lawyer told the court that the trial court did not listen to his client’s point of view. He added that his client was innocent and appealed to the court for justice.

The LHC, while suspending the order, directed the FIA to submit its response in the case within two weeks and issued a notice to complainant Hamiza Mukhtar.

The court directed the complainant to present her stance in person or through her lawyer.

The Pakistan team skipper had challenged an order by a sessions court directing the FIA to register a case against him under the cybercrime law on the harassment complaint.

Mukhtar has accused Azam and others of hurling death threats on WhatsApp messages through different mobile numbers.

She said she was continuously blackmailed by the suspects. They said they would upload fake pictures of her on social media if she did not accept their demands, she said.

The FIA in its report filed with the court said the cricketer did not appear before the investigating officer; however, his elder brother appeared and sought time on behalf of his younger brother to record a statement.

“Since, a regular inquiry has been commenced with respect to the complaint of the petitioner. Thus, the respondent (FIA) is directed to proceed further with respect to registration of FIR against the culprits within the stipulated time after committing legal formalities,” said the sessions court in the order.

Mukhtar previously levelled allegations of miscarriage/abortion and deceitful intercourse on the false assurance of marriage against the cricketer.

She accused Azam of maintaining illicit relations and making false promises of marriage. She also alleged that she got pregnant in 2015 with a baby of Azam but on his wish, she got an abortion. Later, they reportedly reconciled.

لاہور (وقائع نگار خصوصی) لاہور ہائیکورٹ نے فیڈرل انویسٹی گیشن ایجنسی (ایف آئی اے) کو ہراساں کرنے کی شکایت پر پاکستان کے کپتان بابر اعظم کے خلاف مقدمہ درج کرنے کا حکم جاری کرتے ہوئے پیر کے روز معطل کردیا۔

درخواست میں ، اعظم کے وکیل نے عدالت کو بتایا کہ ٹرائل کورٹ نے اپنے مؤکل کے نقطہ نظر کو نہیں سنا۔ انہوں نے مزید کہا کہ ان کا مؤکل بے قصور ہے اور انہوں نے عدالت سے انصاف کی اپیل کی۔

پاکستان ٹیم کے کپتان نے سیشن عدالت کے حکم کو چیلنج کیا تھا کہ ایف آئی اے کو ہراساں کرنے کی شکایت پر سائبر کرائم قانون کے تحت ان کے خلاف مقدمہ درج کرنے کی ہدایت کی تھی۔

مختار نے اعظم اور دیگر پر مختلف موبائل نمبروں کے ذریعے واٹس ایپ پیغامات پر موت کی دھمکیاں دینے کا الزام عائد کیا ہے۔

اس نے بتایا کہ انہیں ملزمان کے ذریعہ مسلسل بلیک میل کیا جاتا تھا۔ انہوں نے کہا کہ اگر وہ ان کے مطالبات کو قبول نہیں کرتی ہیں تو وہ سوشل میڈیا پر اس کی جعلی تصاویر اپ لوڈ کریں گی۔

ایف آئی اے نے عدالت میں دائر اپنی رپورٹ میں کہا ہے کہ کرکٹر تفتیشی افسر کے سامنے پیش نہیں ہوا۔ تاہم ، اس کا بڑا بھائی حاضر ہوا اور اپنے چھوٹے بھائی کی جانب سے بیان ریکارڈ کروانے کے لئے وقت مانگا۔

انہوں نے کہا کہ جب سے درخواست گزار کی شکایت کے سلسلے میں باقاعدہ انکوائری شروع کی گئی ہے۔ اس طرح جواب دہندگان (ایف آئی اے) کو ہدایت کی گئی ہے کہ وہ قانونی رسمی انجام دینے کے بعد مجرموں کے خلاف مقررہ وقت میں ایف آئی آر کے اندراج کے سلسلے میں مزید کارروائی کرے۔

مختار نے اس سے قبل کرکٹر کے خلاف شادی کی جھوٹی یقین دہانی پر اسقاط حمل / اسقاط حمل اور فریب کاری کے الزامات لگائے تھے۔

اس نے اعظم پر ناجائز تعلقات برقرار رکھنے اور شادی کے جھوٹے وعدے کرنے کا الزام عائد کیا۔ اس نے یہ بھی الزام لگایا کہ وہ 2015 میں اعظم کے ایک بچے کے ساتھ حاملہ ہوگئی تھی لیکن اس کی خواہش پر اسقاط حمل کروایا گیا۔ بعد میں ، انہوں نے مبینہ طور پر صلح کر لی۔
